Nicht nur sinkende Umfragewerte lassen die Bundeskanzlerin fr?steln, auch im Kanzleramt weht derzeit ein eisiger Wind – das Blockheizkraftwerk des Geb?udes ist defekt. Auch an weiteren Bundesgeb?uden zeigen sich erste Baum?ngel.</strong></p>

<p>Gerade mal zehn Jahre nach dem Umzug nach Berlin gibt es die ersten ernsten baulichen M?ngel an Geb?uden des Bundes. So liefert das unter Umweltaspekten vorbildlich mit Pflanzen?l betriebene Blockheizkraftwerk des Kanzleramtes nach einem Bericht der Berliner Zeitung derzeit weder Strom noch W?rme. Damit die Bundeskanzlerin und ihre Entourage nicht im Dunkeln frieren müssen, wird der Strom über das normale Netz bezogen und die Heizung mit herk?mmlicher Kesseltechnik betrieben.</p>
<p>Weitere M?ngel zeigten sich zudem an der Dachverglasung der Winterg?rten und an der Sprinkleranlage. Nach Angaben des stellvertretenden Regierungssprechers Thomas Steg ist die Regierungsarbeit nicht beeintr?chtigt, die Sanierungsarbeiten seien aber bereits für dieses Jahr geplant. Am Hauptgeb?ude des Kanzleramtes wird unterdessen erst im n?chsten Jahr gebaut, dort sollen Probleme an der Lüftungstechnik behoben werden. Ob F?rdergelder der staatlichen KfW zur energetischen Sanierung ben?tigt werden, ist derzeit noch nicht sicher…</p>

<p>Erst am Dienstag hatte Bundespr?sident K?hler mit der Unterzeichnung des sogenannten Rettungsübernahmegesetzes den Weg für die Verstaatlichung der Bank freigemacht. Der Bund ben?tigt noch 42,3 Prozent der Aktien, um auf einer einzuberufenden Aktion?rsversammlung eine Kapitalerh?hung zu beschlie?en. In einem ersten Schritt übernahm der Bund bereits 8,7 Prozent der Anteile.
<p>Der Bund strebt eine 100%ige übernahme der Bank an, um den Immobilienfinanzierer langfristig zu stabilisieren. Dem steht allerdings noch die ablehnende Haltung des Gro?aktion?rs JC Flowers entgegen, der auch weiterhin Anteilseigner der Bank bleiben will.</p>
<p>Gegenüber dem Vortageskurs des Papiers w?re das ein Aufschlag von 16 Prozent, als das Papier zu B?rsenschluss im MDax bei 1,20 Euro notierte. Im Verstaatlichungsgesetz ist als Mindestpr?mie ein Aufschlag von 10 Prozent vorgeschrieben. </p>
<p>Die Bundesrepublik will mit dem am Donnerstagabend vorgelegten Angebot mehr zahlen, als in den letzten Tagen kolportiert wurde. In B?rsenkreisen ging man von einem Preis von rund 1,26 Euro je Aktie aus. Ingesamt will der Bund damit knapp 290 Millionen Euro für die schwer angeschlagene Bank bieten, was einem Aktienpreis von 1,39 Euro entspricht.</p>

<p>As we explained in our e-mail to CNET, this decision may have given the open-source movement a great boost by making it easier to enforce open-source licenses. The purpose of our e-mail was to spark meaningful discussion with CNET and other publications on the issues in the decision, of which Mr. Asay was most certainly aware and which would have been clear to your readers, had the e-mail not been selectively edited to remove the invitation at the note&#8217;s end. </p>
<p>The movement may well have been given a great boost by a recent court decision that makes it easier to enforce open-source licenses. But the unintended side effect may be that many software developers who incorporate bits and pieces of open-source code in commercial programs will now face greater risks of significant legal penalties for doing so. </p>
<p>This is the theory of the (GNU General Public License) and all (Creative Commons) licenses. Put precisely, whether or not they are also contracts, they are copyright licenses which expire if you fail to abide by the terms of the license.</p>

<p>Perhaps nothing makes its struggle as clear as its attempt to drum up business by scaring prospective and current clientele into retaining its services to address the <i>very scary</i> open-source legal threat, as a recent e-mail sent out to a friend suggests:</p>
<p>Last December, a decision by the U.S. Court of Appeals for the Federal Circuit in the matter of Jacobsen v. Katzer held that breach of an open-source license can support a claim for copyright infringement&#8211;with associated remedies. The Court&#8217;s ruling may also require recognizing that the open-source copyright owner has standing to sue downstream licensees for copyright infringement&#8230;.</p>

<p>It is absolutely the case that there are legal risks in open source, but the same is 100 percent true of proprietary software. Indeed, the same risks that Mr. Moskin points out in open-source software exist in proprietary software.</p>

<p>It&#8217;s also a reason to retain a different law firm, one that recognizes the opportunities in open source and isn&#8217;t fixated on risks mostly of its own invention.</p>
<p>Indeed, legal expert Larry Lessig calls the Jacobsen decision &#8220;huge and important,&#8221; and explains the appellate court&#8217;s finding in very different terms than White &#38; Case:</p>
<p>So while it may be good business for White &#38; Case to spread FUD (fear, uncertainty, and doubt) within its clientele to drum up business in a weak economy, the case it references is a big win for <i>clarity</i> around open-source licensing. This is something to celebrate, not fear.</p>
<p>This is an interesting perspective, one that explicitly cuts against the generally positive perspective on the lawsuit that Mark Radcliffe and other experts on open-source law have suggested.</p>

<p>In an effort to stay focused on its goals, Cisco has vowed to cut $1 billion spending for fiscal 2009, which ends in July. And Chambers said the company is on track to meet that goal.</p>
<p>Cisco, which sells Internet equipment to service providers and large companies, reported net income of $1.5 billion on sales of $9.1 billion for is second fiscal quarter, which ended in January. Despite the fact that sales dipped 7.5 percent from the same quarter a year ago, they were slightly better than what analysts had expected. Analysts had expected revenue to dip about 12 percent year-over-year to about $9 billion.</p>
<p>Cisco Systems&#8217; optimistic leader John Chambers noted during the company&#8217;s conference call Wednesday that the economy has gone from bad to worse as sales are expected to slip as much as 20 percent in the next quarter. But he said that Cisco is well-positioned to emerge even stronger after the economic malaise.</p>
<p>Chambers noted that revenues for the company&#8217;s third fiscal quarter, which ends in April, will be down 15 percent to 20 percent from the previous year. In dollars, this means revenue are expected to be around $7.83 billion to $8.32 billion. Analysts had expected a forecast of about $8.71 billion, according to Thomson Financial.</p>
<p>Chambers said most of his customers don&#8217;t expect the economy to get better until 2010. But always the optimist, he believes things will turn around more quickly than many people believe. Although he was careful not to cite a specific time frame for recovery, he said the Obama stimulus package in the U.S. and efforts by other governments throughout the world should help kick-start the economy around the globe stimulate a recovery.</p>

<p>Three months ago during the company&#8217;s first-quarter earnings call, Chambers noted that the economic downturn had spread from the U.S. to Europe. This time around, he said that it is now affecting countries throughout the world.</p>
<p> &#8220;Cisco showcased solid financial strength during a period of significant economic challenge,&#8221; Chambers said in a statement. &#8220;We remain comfortable with our long-term vision and strategy as we move into new market adjacencies and prioritize our existing opportunities.&#8221;</p>
<p>&#8220;We must gain from this economic pain,&#8221; he said. &#8220;This downturn is the biggest challenge of our lifetime, but it&#8217;s also the biggest opportunity for the company and the country to change our economy.</p>
<p>But he added that Cisco is not planning any major layoffs, which he defined as a cut of at least 10 percent of the company&#8217;s workforce. Instead, he said the company is realigning business units and refocusing resources and headcount on growth areas. In doing this, he said that some jobs will be lost. As a consequence, Cisco will shed between 1,500 and 2,000 through this realignment. Cisco currently employs 67,000 people worldwide. Chambers also emphasized that this activity is normal for the company and is done both in good times and in bad times. </p>
<p>The company&#8217;s earnings per share was 32 cents, down about 15.8 percent from the same period a year ago. This was better than analysts had expected. Analysts were expecting Cisco to earn 29 cents to 30 cents per share.</p>
